Trump's Media Ban Triggers Lawsuit From CNN, MS NOW and Politico as TV Networks Halt Coverage

This post asks whether President Trump's decision to bar CNN, MS NOW and Politico from the White House was a lawful use of his authority, not whether the outlets' eventual lawsuit will succeed in court.

Trump announced Friday on Truth Social that he was banning CNN, MS NOW and Politico from the White House over what he called their "constant reporting FAKE NEWS." On Saturday, reporters from the three outlets, including CNN's Betsy Klein, MS NOW's Akayla Gardner and Politico's Cheyenne Haslett, had their hard passes deactivated and were turned away at the gates. CNN was also pulled from its scheduled turn covering Trump's Monday travel pool duty ahead of his trip to New York for the United Nations General Assembly.

On Monday, the three outlets jointly sued the administration in the U.S. District Court for the District of Columbia, naming Trump, Communications Director Steven Cheung and Secret Service Director Sean Curran as defendants and citing First and Fifth Amendment violations. The case was assigned to Judge Timothy Kelly, a Trump appointee who oversaw a similar 2018 dispute involving CNN's Jim Acosta. Kelly ordered the Justice Department to respond to the outlets' request for a temporary restraining order by Tuesday. Separately, the five networks that share White House pool duties announced they would not provide replacement video coverage of the president's public events until the ban is lifted.

Arguments for:

  • The White House controls access to its own grounds and has broad discretion to set credentialing rules, and officials argue the barred outlets' coverage crossed from reporting into advocacy.

  • Presidents have restricted access to specific reporters before without it ending press coverage of the executive branch altogether, since other outlets remain free to cover the White House.

Arguments against:

  • A 1977 federal appeals court precedent holds that once a reporter is credentialed, access cannot be revoked based on the content of their reporting, which is the core of the outlets' legal argument.

  • No advance notice or appeals process was offered before the badges were deactivated, raising a separate due process problem beyond the First Amendment claim.

  • The other major networks' decision to halt pool coverage in solidarity shows the ban's effects are already spreading beyond the three outlets originally targeted.
